The Rules
- Open a stop's page and tap Check in. Your phone's location does the rest.
- Adding a photo of your meal is optional. It is private to you, and your friends can see it once we have approved it. Snap a new one every visit and we keep them all, so you never forget what you had last time.
- 100 points a stamp, +25 the first time you visit a restaurant, +500 for the full Passport.
- Check ins count while the restaurant is open, at most 4 a day, with a short wait between them.
- One stamp per stop. Your display name and photo appear on the leaderboard.
Official rules
OUTSIDE EATS PASSPORT CAMPAIGN
OFFICIAL RULES AND PARTICIPATION TERMS
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. PRIZES ARE OFFERED ONLY WHEN EXPRESSLY IDENTIFIED IN THE APPLICABLE CAMPAIGN DETAILS.
1. Sponsor and applicable campaign
The Outside Eats Passport campaign identified on the applicable campaign page (the “Campaign”) is sponsored and administered by Outside Eats LLC (“Outside Eats” or “Sponsor”).
Sponsor mailing address: Outside Eats, 1259 El Camino Real, Unit #1145, Menlo Park, CA 94025
Contact: [email protected]
These Official Rules govern participation in the Campaign, including check-ins, stamps, points, leaderboard standings, winner selection, prize claims, and any prizes. By participating, participants agree to these Official Rules and the applicable Campaign Details.
Before participation begins, the Campaign page will identify:
- The Campaign name, opening and closing dates and times, and any daily participation windows.
- Eligible locations, qualifying activities, scoring rules, bonuses, and completion requirements.
- Any additional eligibility restrictions.
- Whether the Campaign offers recognition only or prizes.
- For a prize Campaign, the number, description, and stated U.S. dollar value of each prize; qualifying requirements; winner-selection method; and scheduled winner-determination date.
These published details (the “Campaign Details”) are incorporated into these Official Rules. Campaign-specific values expressly contemplated by these Rules are governed by the Campaign Details. Otherwise, these Official Rules control over inconsistent promotional statements.
2. Eligibility
Unless a narrower eligibility area is expressly stated before the Campaign begins, prize eligibility is limited to legal residents of California who are at least eighteen (18) years old when they enter and maintain an Outside Eats account in good standing.
Employees, officers, directors, and persons directly involved in administering the Campaign or determining its results, together with their immediate family and household members, are not eligible to receive prizes. For this purpose, immediate family includes a spouse or domestic partner, parents, children, and siblings. Staff and test accounts are ineligible for public Campaign prizes.
One participant may use only one account. Accounts, stamps, points, entries, and prize eligibility may not be shared, sold, or transferred.
3. Campaign period
The Campaign begins and ends at the dates and times stated in the Campaign Details (the “Campaign Period”). All times are Pacific Time, observing daylight saving time when applicable.
Qualifying activity must occur during the Campaign Period and within any published daily participation windows. Sponsor’s official system records will determine timing, subject to correction of verified errors.
Activity after the closing deadline does not count, except that Sponsor may correct records of qualifying activity that actually occurred before the deadline.
4. Free participation and qualifying check-ins
Participation requires a free Outside Eats account and the free Outside Eats app. No purchase, payment, paid membership, or donation is required to participate, earn any Campaign stamp or point, qualify for a prize, or win.
Participants must follow the published check-in instructions using their own Outside Eats account. Location-based check-ins require the participant to be physically present within the published permitted area for the eligible location and to provide the location permissions reasonably required to verify that check-in.
Participants may complete qualifying check-ins without purchasing food, beverages, or other goods or services. Making a purchase does not award additional points, improve leaderboard standing, or increase the chance of winning. No receipt or proof of purchase is required.
Meal photographs are optional and do not affect Campaign scoring or prize eligibility. A marketing subscription is not required to participate or claim a prize.
Participants must remain in areas where they may lawfully be present, follow location rules, and must not trespass or enter restricted areas to complete a check-in. If a participant encounters a purchase requirement or an access restriction that prevents a free qualifying check-in, the participant should contact Sponsor promptly at [email protected].
5. Stamps, points, and leaderboard
Only verified qualifying activity counts. The Campaign Details will state the points awarded per stamp, any first-visit or location bonuses, completion bonuses, daily limits, required waiting periods between check-ins, location radius, and applicable operating-hour requirements.
Unless otherwise stated before the Campaign begins, each eligible stop earns no more than one Campaign stamp per participant. Repeated visits do not create additional stamps or points except as expressly provided in the Campaign Details. All prize-qualifying stamps and bonuses must be available without a purchase or payment.
Stamps, points, badges, and leaderboard positions have no independent cash value and are not redeemable for money. A prize is available only as expressly described in the Campaign Details and these Official Rules.
Live leaderboard standings are provisional. Sponsor may review activity, correct scoring errors, remove invalid activity, and exclude ineligible accounts before determining final standings. Display order between participants with equal scores does not itself establish a winner.
Scoring questions and corrections. Participants should report missing stamps, missing points, or other scoring errors to [email protected] promptly and no later than seven (7) calendar days after Campaign close. Reports should identify the Campaign, account display name, affected location, approximate check-in date and time, and the issue. Do not include passwords or other sensitive account credentials. Sponsor will review timely reports that may affect prize standings before finalizing the affected awards. The published winner-determination date must allow for this review period. Sponsor may also correct verified Sponsor or system errors identified later, subject to applicable law. This reporting window does not waive nonwaivable legal rights.
6. Winner selection and ties
The winner-selection method must be identified before the Campaign begins. Sponsor will not choose a different method after reviewing participant results.
Recognition only. A Campaign designated “recognition only,” “bragging rights,” or “no prize” does not award money, a gift card, or another item of monetary value. A Champion designation, badge, completed Passport, or leaderboard position does not create a right to payment.
Top score. Prizes are awarded according to the highest verified Campaign point totals among eligible participants, subject to the published prize schedule and any minimum qualifying requirements.
Tied scores affecting prizes. If eligible participants have the same final verified score and the tie affects entitlement to a prize or its value, Sponsor will conduct a random drawing solely among those tied participants. Each tied participant receives one equal entry. For one prize among N tied participants, each participant’s chance is 1 in N.
If a tie affects multiple prize positions, Sponsor will randomly order the tied participants without replacement and assign the affected prizes in that order. A tie does not increase the number or total value of advertised prizes, and prizes will not be split unless the Campaign Details expressly provide otherwise.
Separate drawing or combined format. If the Campaign Details expressly provide for a drawing independent of a leaderboard tie, they must separately state its qualifying threshold, entry limits, number of winners, prize allocation, and whether a participant may win both a leaderboard prize and a drawing prize. Unless otherwise stated, each qualified participant receives one entry, and selection is without replacement. Odds depend on the number of eligible entries. This paragraph does not create a separate drawing for a Campaign that advertises only top-score prizes and tie-breaking drawings.
Sponsor will document each drawing and conduct it using a reasonably reliable random-selection process. Potential winners remain subject to eligibility and activity verification.
7. Prizes and monetary awards
Only prizes expressly listed in the Campaign Details will be awarded. A Campaign may offer no monetary prize, no nonmonetary prize, or no prize at all.
Any monetary award will be fulfilled as a Visa prepaid gift or reward card delivered through Tremendous.com, with the face value stated in the Campaign Details. References to a “cash prize” describe the award’s stated dollar value; fulfillment is by the specified Visa card rather than currency, check, bank transfer, or an ATM withdrawal right.
The Campaign Details will identify the number of prizes, each prize’s value, and the total advertised prize value. Participants may not demand a different payment method. Selection of email or text-message delivery during the claim process does not change the prize type or value.
If the advertised card becomes unavailable, Sponsor may substitute a lawful prize of equal or greater value and disclose the substitution to the affected winner. Sponsor will not reduce an advertised prize because participation is lower than expected.
8. Winner determination and notification
Sponsor will review results and determine potential winners by the winner-determination date published in the Campaign Details.
Outside Eats will notify potential winners by email to the email address on file in their Outside Eats account at Campaign close. The email will include a link to the designated prize-claim webpage and state the claim deadline, including the applicable date and time in Pacific Time.
The claim period begins when Outside Eats sends the initial winner-notification email. Sponsor will retain a record of the email address used, the send date and time, and the stated claim deadline. A reminder or duplicate email does not restart the claim period unless Outside Eats expressly provides an extension.
Participants are responsible for keeping their account email address accurate and accessible at Campaign close and for monitoring their email, including spam and junk folders. Winner and claim-related emails are Campaign administration messages; a marketing subscription is not required to receive them or claim a prize.
Sponsor may correct notification information after reasonably verifying the account holder’s identity. Sponsor will not require payment to claim or receive a prize.
9. Thirty-day claim deadline and forfeiture
A potential winner must complete and submit the required form on the designated prize-claim webpage within thirty (30) calendar days after Outside Eats sends the initial winner-notification email.
To complete a claim, the potential winner must provide the information required by the claim form, select an available delivery method, and confirm the corresponding email address or mobile telephone number. Merely opening the email, visiting the claim webpage, or sending an informal acknowledgment does not constitute a completed claim.
Claim confirmation and security. Outside Eats will provide a confirmation on the claim webpage or by email showing the date the completed claim was received. The submission date, rather than the date a confirmation is viewed or a claim is reviewed, starts the sixty-day delivery period. Participants who submit a claim but receive no confirmation should contact [email protected] promptly. Prize-claim links are personal to the notified account holder and must not be shared. Possession or forwarding of a claim link does not transfer prize rights. Sponsor may verify account ownership before accepting a claim or changing delivery information.
Failure to complete and submit the required claim within the thirty-day period will result in forfeiture of the prize, subject to applicable law. A potential winner who declines the award, is ineligible, or submits materially false information also forfeits the award.
Outside Eats will not order or issue a Tremendous Visa reward card before a completed claim. The claim deadline concerns claiming the prize from Outside Eats; it is not a deadline to redeem a Tremendous reward invitation or spend an issued Visa card.
Sponsor will reasonably extend the claim deadline when a documented Sponsor or service-provider error prevents timely claiming, or when required by law. A timely reported problem with the claim webpage will not itself cause forfeiture while Sponsor is resolving that problem.
A forfeited prize will be offered to an alternate eligible participant using the original selection method. For a leaderboard prize, Sponsor will select from the remaining eligible participants at the highest applicable score, resolving any tie by an equal-chance drawing. For a separate drawing prize, Sponsor will draw from the remaining eligible drawing pool. Each alternate will receive a separate winner-notification email and thirty-day claim period. If no eligible participant remains, the prize will not be awarded.
10. Prize delivery within sixty days after claim
Subject to verification of eligibility, Outside Eats will arrange delivery of the prize as a Visa prepaid gift or reward card through Tremendous within sixty (60) calendar days after the winner submits the completed claim.
The sixty-day delivery period starts on the date the required claim form is completed and submitted. It does not start at Campaign close, winner determination, or the initial winner-notification email.
Delivery will be made by the available email or text-message option selected by the winner, using the delivery information confirmed in the claim form. This confirmed delivery information will control prize delivery even if it differs from the account information used for the initial winner notification.
The winner is responsible for providing accurate delivery information and following Tremendous’s instructions to access the issued reward. Before issuance, the winner should promptly report a delivery-address error to [email protected]. Sponsor may correct that information after verifying the claimant’s identity. An ordinary correction does not restart the sixty-day delivery period. After issuance, corrections or replacement requests will be handled with Tremendous and the card issuer under their applicable procedures and law; an automatic replacement or duplicate payment is not guaranteed. Sponsor may reasonably request identity, eligibility, or legally required tax documentation through a designated secure process. Sponsor will state a reasonable response deadline for any such request. A timely completed claim will not be treated as late solely because Sponsor completes its review afterward.
Sponsor will not restart the sixty-day delivery period merely because its own verification or processing occurs after claim submission. If legally required documentation remains outstanding, Sponsor may withhold delivery to the extent required by law and will notify the claimant of the deficiency and the steps needed to resolve it.
The thirty-day Outside Eats claim deadline does not require the winner to spend the issued Visa card balance within thirty days. Once issued, reward access, redemption, card use, expiration, and any permitted fees are governed by the applicable Tremendous terms, cardholder agreement, and law.
11. Card terms and taxes
Visa cards are subject to the issuing institution’s cardholder agreement, merchant acceptance, geographic restrictions, activation requirements, expiration terms, and any lawfully applicable fees disclosed during fulfillment.
Winners are responsible for applicable taxes. Sponsor may require a completed Form W-9 or other legally necessary documentation and will report or withhold amounts as required by law. Sensitive tax information must be submitted through the designated secure process, not ordinary email or text.
12. Fair participation and disqualification
Location spoofing, fabricated check-ins, duplicate accounts, bots, automated entries, tampering, identity misrepresentation, and attempts to evade published limits are prohibited.
Sponsor may remove invalid activity or disqualify a participant based on a reasonable, documented determination of a material rules violation. Sponsor may request information reasonably necessary to verify eligibility or participation.
Administrative decisions will be made in good faith and consistently with these Rules. Nothing in this section prevents a participant from exercising nonwaivable legal rights.
13. Privacy, photographs, and intellectual property
Campaign information will be handled under the Outside Eats Privacy Policy.
Check-in records and friends-only visibility. Outside Eats collects and retains account-linked check-in records identifying the location visited and the date and time of the check-in. These records document a participant’s presence at that location and support check-in verification, scoring, Campaign administration, and fraud review. Within the app, a participant’s location-specific, timestamped check-in activity is shared only with that participant’s accepted friends, in addition to being available to the participant. It is not displayed publicly or made visible to other app users who are not accepted friends.
Friends-only visibility describes sharing with other users; it does not prevent necessary access by authorized Outside Eats personnel or service providers supporting the feature, or disclosures required by law. Retention, deletion requests, and any legally permitted retention for security, disputes, or compliance are governed by the Privacy Policy.
Leaderboard information. Separately from friends-only check-in activity, a participant’s display name, profile image, total points, stamp count, and standing may appear according to the Campaign’s disclosed leaderboard settings. Public leaderboard totals do not authorize public disclosure of the participant’s individual visited locations or check-in timestamps.
Prize and claim information. Outside Eats retains records reasonably necessary to administer winner selection, notifications, claims, delivery, and related tax or legal obligations in accordance with the Privacy Policy. Information reasonably necessary to deliver a prize may be shared with Tremendous, the card issuer, and necessary service providers. Prize fulfillment does not authorize sharing a participant’s check-in history with those providers for unrelated purposes. Prize administration does not itself constitute consent to unrelated advertising messages.
Participants retain ownership of their submitted photographs. Uploading a photograph does not transfer copyright to Sponsor. A submitted photograph is reviewed by Outside Eats before any person other than the participant who uploaded it can see it; a photograph that is not approved is deleted and is never displayed. Any permitted use remains subject to the applicable Outside Eats user terms and privacy settings. Promotional use of a winner’s likeness or photographs beyond those permissions requires separate consent where required by law and is not a condition of receiving a prize.
Outside Eats names, branding, and Campaign materials remain the property of their respective owners. Participation grants no ownership interest in them. Third-party names and marks, including Visa and Tremendous, belong to their respective owners. Identifying a fulfillment provider or card brand does not itself imply that either sponsors or administers the Campaign.
App store disclaimer. Apple Inc. and Google LLC are not sponsors of, and are not involved in, this Campaign in any manner. Neither has endorsed or administered it. Outside Eats is responsible for administering the Campaign and awarding its prizes. This Campaign is in no way associated with the App Store or Google Play.
14. Interruptions, corrections, and cancellation
If fraud, technical failure, location closure, disaster, or another circumstance materially prevents fair administration, Sponsor may take reasonable corrective action, including pausing affected activity, correcting records, or modifying or ending the affected portion of the Campaign.
Sponsor will explain material changes on the Campaign page and preserve earned participation and advertised prize commitments to the extent reasonably possible and lawful. Sponsor will not retroactively change scoring or winner-selection rules to favor a participant.
If early termination is necessary, Sponsor will use the published selection method and valid activity received before termination to award advertised prizes where reasonably possible and legally permitted.
15. Independent restaurants, responsibility, and limitations
Independent restaurants and locations. Restaurants, venues, and other locations listed in a Campaign are independently operated. Listing a location does not, by itself, make its owner or staff a Campaign sponsor, administrator, agent, or representative of Outside Eats. Unless expressly identified in the Campaign Details as having that role, a location and its staff have no authority to change these Official Rules, adjust Campaign scoring, select winners, promise prizes, extend claim deadlines, or bind Outside Eats to a commitment. Campaign questions and prize claims must be directed to Outside Eats.
Outside Eats does not operate or control the listed locations, prepare their food, or guarantee their hours, menus, availability, accessibility, or services. Each location remains responsible for its own operations. This disclaimer does not limit Outside Eats’ express Campaign or prize obligations or exclude liability that cannot lawfully be excluded.
Participants must follow applicable laws and location rules and remain responsible for their travel, personal safety, and voluntary purchases. Participation does not require ordering food or consuming alcohol.
To the extent permitted by law, Sponsor is not responsible for failures outside its reasonable control, including inaccurate participant contact information, participant device failure, or third-party communications outages. This provision does not excuse Sponsor from its express prize obligations or responsibility for its own actionable conduct.
Nothing in these Rules excludes liability for fraud, willful misconduct, gross negligence, or any liability or consumer right that cannot lawfully be excluded.
16. California law and San Mateo County venue
These Official Rules and disputes arising from the Campaign are governed by California law, together with applicable federal law, without applying conflict-of-laws rules that would select another jurisdiction’s law.
To the extent permitted by law, legal proceedings concerning the Campaign must be brought in the Superior Court of California, County of San Mateo, or, where federal jurisdiction exists, the United States District Court for the Northern District of California.
For Campaign disputes, this section controls over inconsistent dispute-resolution provisions in general Outside Eats user terms. It does not waive nonwaivable consumer rights or restrict complaints to government agencies.
If a provision of these Rules is held unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
17. Questions and results
Questions about eligibility, scoring, prize claims, delivery, or final results may be sent to [email protected], identifying the Campaign and the participant’s account display name. Do not send passwords, Social Security numbers, or full card details by email.
Final verified results will be posted on the Campaign page or made available upon request in a manner consistent with applicable privacy requirements.
